Terms and Conditions for Courses and Training Events
1. Definitions and Interpretation
In these Terms and Conditions:
“Cambridge OCR”, “we”, “us” or “our” means Oxford Cambridge and RSA Examinations, a company limited by guarantee registered in England. “Course” or “Training Event” means any training course, professional development event or related meeting (whether delivered in person or online) offered by Cambridge OCR. “Delegate” means the individual attending a Course or Training Event. “Booking Party” means the individual or organisation that makes a booking for a Course or Training Event, whether for themselves or on behalf of a Delegate. “Working Day” means Monday to Friday, excluding public holidays in England. References to words such as “including” or “without limitation” shall be construed as illustrative and not limiting.
2. The Booking Process
Booking Methods
Bookings for Courses and Training Events must be made through Cambridge OCR’s online booking portal, which is accessible via the Cambridge OCR website or via Teach Cambridge.
Where a Delegate is unable to complete a booking through the online portal due to technical issues, a booking may alternatively be made by email using the contact details provided by Cambridge OCR.
Cambridge OCR will accept responsibility only for bookings made through the online booking portal or by email in accordance with this section. Bookings submitted by any other method will not be accepted or processed.
Acknowledgement and Confirmation
On submission of a booking request, the Booking Party will receive an automated acknowledgement confirming receipt of the booking. This acknowledgement does not constitute confirmation that the Course or Training Event will proceed.
Formal confirmation will be issued by Cambridge OCR closer to the scheduled date of the Course or Training Event, once the event has been confirmed as proceeding.
Cambridge OCR reserves the right to cancel a booking where a Course or Training Event does not proceed, or where a booking is submitted by a person who is not eligible to attend, including students or parents. Any fees paid in respect of a cancelled booking will be refunded.
Allocation of Places
Places on Courses and Training Events are allocated in the order in which valid booking requests are received and accepted by Cambridge OCR, subject to availability.
Waiting Lists
Where a Course or Training Event is fully booked, Delegates may have the option to join a waiting list.
If a place subsequently becomes available, Cambridge OCR will notify Delegates on the waiting list using the contact details provided. Places will be offered in sequence and must be accepted within the timeframe specified in the notification.
If a Delegate does not accept an offered place within the specified timeframe, the offer will lapse and may be made to the next Delegate on the waiting list. Cambridge OCR cannot guarantee that a further opportunity to book the same Course or Training Event will be available.
Any place offered via the waiting list will be for the same Course and delivery format, but the date or location may differ from those originally advertised.
Responsibility for Booking Details
The Booking Party is responsible for ensuring that all booking details are accurate and that any required internal approvals or procedures have been completed before submitting a booking.
Cambridge OCR is not responsible for errors, omissions or failures arising from the Booking Party’s internal processes or from incorrect information provided at the time of booking.
Catering and Dietary Requirements
Where catering is provided as part of a Course or Training Event, Cambridge OCR will take reasonable steps to notify the venue of any dietary requirements communicated by the Delegate in advance of the event.
Catering is provided by third-party venues and suppliers. While Cambridge OCR will use reasonable endeavours to support the provision of suitable catering and will seek to inform Delegates where dietary requirements cannot be accommodated, Cambridge OCR cannot guarantee that all dietary needs will be met and accepts no responsibility for errors or omissions on the part of the venue or catering provider.
Accessibility and Reasonable Adjustments
Cambridge OCR is committed to ensuring that Courses and Training Events are accessible and will take reasonable steps to support Delegates who require reasonable adjustments.
Delegates are responsible for informing Cambridge OCR of any reasonable adjustment requirements at the earliest possible opportunity prior to the Course or Training Event.
While Cambridge OCR will use reasonable endeavours to select accessible venues and support reasonable adjustments, it cannot guarantee that all requests can be met and accepts no responsibility for limitations arising from third-party venues or providers.
Accuracy of Bookings
Delegates are responsible for ensuring that the details of their booking are correct at the time the booking is submitted, including the selected Course, date, location and delivery format.
Cambridge OCR is not responsible for bookings made in error, and any changes or cancellations requested as a result will be subject to these Terms and Conditions.
Expressions of Interest
Where a Delegate registers an expression of interest in a Course or Training Event, including by joining a waiting list or otherwise notifying Cambridge OCR of their interest, this does not constitute a booking or guarantee the availability of a place.
If Cambridge OCR schedules an additional instance of a Course or Training Event in response to demand, it may notify those who have registered an expression of interest and invite them to make a booking, subject to availability.
3. Booking on Behalf of Another Person
Where a booking is made on behalf of another person, the Booking Party is responsible for ensuring that the Delegate is available to attend the Course or Training Event at the scheduled date and time.
Cambridge OCR will not be responsible where a Delegate is unable to attend due to availability or scheduling issues, provided that the Booking Party or Delegate had the opportunity to cancel in accordance with these Terms and Conditions.
The Booking Party is responsible for ensuring that the selected Course or Training Event is suitable for the Delegate. Any request to change or cancel a booking made in error will be subject to the cancellation provisions set out in these Terms and Conditions.
The Booking Party is responsible for providing accurate and up-to-date contact details for the Delegate and confirms that they are authorised to provide the Delegate’s personal data to Cambridge OCR. Cambridge OCR may use the contact details provided to communicate directly with the Delegate in connection with the Course or Training Event.
Where a booking is made on behalf of another person, the Booking Party is responsible for ensuring that the Delegate is made aware of, and has access to, these Terms and Conditions prior to attending the Course or Training Event. Attendance is conditional on compliance with these Terms and Conditions, regardless of who made or paid for the booking.
4. Payment and Fees
Payment for charged Courses and Training Events may be made either by invoice or by debit or credit card, as determined during the booking process.
Where an employer or organisation is identified at the time of booking, Cambridge OCR may issue an invoice to that organisation. Where no employer or organisation is identified, payment must be made by debit or credit card at the time of booking.
Where payment is made by invoice, invoices will be issued following the date of the Course or Training Event, in accordance with Cambridge OCR’s applicable finance terms.
Cambridge OCR reserves the right to set and amend fees for Courses and Training Events from time to time. Any changes to fees will apply only to new bookings made after the revised fees are published and will not affect existing confirmed bookings.
Cambridge OCR may, at its discretion, offer discounted rates, fee waivers or free Courses or Training Events. Such discounts or waivers do not create an entitlement to reduced fees for future bookings.
Where a Course or Training Event is advertised as free of charge, no course fee will be payable, but all other provisions of these Terms and Conditions will continue to apply.
5. Cancellations, Transfers and Refunds
A Delegate or Booking Party may cancel a booking up to three Working Days before the scheduled start date of the Course or Training Event.
Cancellations may be submitted through the applicable booking system and may also require written confirmation by email.
Where a booking is cancelled more than three Working Days before the event, the course fee will be refunded in full. Where a booking is cancelled within three Working Days of the event, no refund will be payable.
Refunds will be made to the Booking Party. Card payments will be refunded to the original payment method. Where payment was to be made by invoice, the invoice will be cancelled or a credit note issued as appropriate.
Cambridge OCR may, at its discretion, permit a booking to be transferred to a different Course or Training Event, subject to availability and the applicable fee. Any difference in fees will be payable by the Booking Party.
Cambridge OCR does not permit substitution of Delegates without prior notification. Where a Delegate is unable to attend, the Booking Party should cancel the booking or request a transfer in accordance with these Terms and Conditions.
Where a Course or Training Event is offered free of charge, no cancellation fee will apply. Delegates are encouraged to notify Cambridge OCR as soon as possible if they are unable to attend.
6. Cancellation by Cambridge OCR and Force Majeure
Cambridge OCR reserves the right to amend, postpone or cancel a Course or Training Event at any time. Where reasonably practicable, Cambridge OCR will provide Delegates with as much notice as possible.
Cambridge OCR accepts no liability for any costs incurred in connection with a cancelled or amended Course or Training Event, including travel, accommodation, subsistence or supply cover costs.
Cambridge OCR will not be liable for any failure or delay caused by events beyond its reasonable control, including industrial action, extreme weather, public health emergencies, acts of government, failure of utilities or transport networks, or other force majeure events.
Where a Course or Training Event proceeds despite such events, the decision to attend rests solely with the Delegate and no refund will be payable.
7. Recording, Photography and Venues
All Courses and Training Events are recorded. In-person events are audio recorded, and online events may include audio, visual and screen recordings.
Recording is a mandatory condition of attendance. Recordings may be used for quality assurance, training and the investigation of complaints. Recordings of in-person events will not be made public. Recordings of online events may be made available via Cambridge OCR’s platforms or websites.
Cambridge OCR may take photographs or make audio-visual recordings at Courses and Training Events for promotional purposes. By attending, Delegates consent to incidental or background inclusion in such materials. Delegates may opt out of direct interviews or featured recordings.
Cambridge OCR may require Delegates to present valid photographic identification for certain Courses or Training Events and will notify Delegates in advance where this is required.
Delegates are responsible for the safety of personal property brought to Courses and Training Events, including equipment requested for participation. Cambridge OCR is not responsible for loss or damage except where caused by its negligence.
8. Online Training
Delegates are responsible for ensuring that they have suitable equipment, software and internet connectivity and for following any technical guidance provided by Cambridge OCR.
Cambridge OCR is not responsible for a Delegate’s inability to access online Courses or Training Events due to issues with the Delegate’s own systems or failure to follow guidance.
Where an online Course or Training Event is affected by a technical failure within systems controlled by Cambridge OCR, Cambridge OCR will take reasonable steps to reschedule the event and offer a refund where a Delegate is unable to attend the rescheduled date.
9. Communications and Privacy
Cambridge OCR may use contact details provided during the booking process to communicate with Delegates and Booking Parties for administrative and service-related purposes.
Personal data will be processed in accordance with Cambridge OCR’s Privacy Policy.
10. Liability
Nothing in these Terms and Conditions limits or excludes Cambridge OCR’s liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.
Subject to the above, Cambridge OCR’s liability in connection with any Course or Training Event shall be limited to the amount of the course fee paid.
11. Governing Law and Jurisdiction
These Terms and Conditions are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
12. Changes to These Terms
Cambridge OCR may amend these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking.
